General Terms and Conditions of Business for the company Huss Neudorf

General Terms and Conditions of Delivery and Payment

       1. Prices and Delivery

The prices are valid for the sale of articles through online shopping at the Online Shop of Jürgen Huss Räucherkerzenherstellung [Incense Cone Production] and accessories.  The prices are for the end consumers and per piece.  They are valid from Sehmatal/district Neudorf.  Postage and delivery costs shall be invoiced separately.  Delivery shall take place at the risk of the customer and at the prices valid on the day of delivery.

1.1 All orders shall be accepted on the condition that delivery is possible.  The customer does not have any right to claims for damage if the delivery is delayed, is only partial, or is not completed.  Partial and subsequent deliveries are admissible.

Deliveries to foreign countries shall be invoiced separately.  You can find these prices in your order.

Depending on the country, delivery shall be carried out either by the German Post or by a shipping company of our choice.

2. Warranty, Notice of Defects, Liability, Statute of Limitations, Guarantee

Notices of defect shall be reported in written form within eight days (received by Jürgen Huss Räucherkerzenherstellung) as according to § 377 HGB [German Commerical Code].  Goods which are returned without our consent shall not be accepted.  Jürgen Huss guarantees that the products are free of defects.  Jürgen Huss Räucherkerzenherstellung guarantees that the descriptions of the products covered by contract and found in product information descriptions are generally applicable.  Technical data and the description found in product information descriptions do not alone guarantee the presence of certain characteristics.  A legal guarantee of the presence of characteristics is only extant if the relevant information is confirmed in written form by Jürgen Huss Räucherkerzenherstellung.

If there is a warranty claim, Jürgen Huss Räucherkerzenherstellung has the choice of rectification of the defects or of a replacement delivery.  The replaced parts shall become the property of Jürgen Huss Räucherkerzenherstellung.  If Jürgen Huss Räucherkerzenherstellung does not remedy a defect within an appropriate grace period set forth in written form, then the customer has the right to either annul the contract or to reduce the purchase price appropriately.  Additional costs involved in remedying a defect as well as additional costs connected to a replacement delivery, in particular for the shipping costs for the replacement part, shall be borne by the customer as long as these additional costs are reasonable with respect to the value of the contract.  If the inspection of a notice of defect indicates that no warranty claim can be made, then Jürgen Huss Räucherkerzenherstellung has the right to demand reimbursement for all expenditures.  Costs for inspection and repairs shall be calculated based on the relevant valid service prices.  The customer is not allowed to transfer claims arising from a warranty.  All further or other claims of the customer except those designated in these terms and conditions, regardless of the legal grounds, are excluded, as long as these terms and conditions do not result in something else being the case.

3.  Other Information and Place of Jurisdiction

The exclusive place of jurisdiction for litigation between the customer and Jürgen Huss Räucherkerzenherstellung is the court of law which presides over the supplier's location and the subject matter, as long as this is legally admissible.  However, Jürgen Huss Räucherkerzenherstellung may always sue at the court which presides over the customer.  If one or more terms or conditions of this contract should become ineffective, the validity of the remaining terms and conditions shall not be affected.  An ineffective term or condition shall be replaced by a valid regulation which reflects the desired economic ends to the greatest extent possible.  The legal relationship between Jürgen Huss Räucherkerzenherstellung and the customer is exclusively subject to the laws of the Federal Republic of Germany.

4. Payment

Payment shall be made in advance.  The products shall be delivered as soon as the money has been credited to our company's account.

5. Sales Documents

All offers are always based on those sales documents which are valid at the time of the offer.  Jürgen Huss Räucherkerzenherstellung has the right to make changes which do not negatively influence the function and the quality of the products depicted.  Minimal deviations from the indicated dimensions are possible due to production conditions and are not a valid reason for making a claim.

In addition, the appearance of colors in the internet shop can vary from the actual colors of the products due to technical reasons and is not a valid reason for making a claim.

6. Reservation of Title

An extended reservation of title and an extended reservation for making corrections are valid for all deliveries.  Delivered goods shall remain the property of Jürgen Huss Räucherkerzenherstellung until the payment of the purchase price has been made in its entirety and until claims which are made by Jürgen Huss Räucherkerzenherstellung against the customer, including such future claims, have obtained judgment.

7.

Terms and conditions other than the foregoing are not binding.  The customer accepts our General Terms and Conditions of Delivery and Payment upon placing an order for our products.
